Problems in the Country
An email I recently recieved:
I need advice please, having bought a property with 30,000 sqm, we now have the local estate agent selling part of our plot for building another house, we have the relevant papers, escritura etc, all logged at land registry. Since he originally sold the plots, he is re-distributing the boundary lines and stealing 10,000 of our land for another house to be built. town hall have told them they cannot build there, but they are selling the house in all its glory on the internet on several sites. advice, please please please please.....
Dear Madam,
First of all you will need to check the cadasatral certificate (shows your physical boundaries). Your IBI receipts contain the reference number for tracking and petitioning the certificate from the local authorities. This document shows the physical boundaries of your property in greater detail than the escritura. If it looks as if there is some boundary conflict, commission an official survey to delineate your property exactly.
The survey will cost approx 500 to 1000 euros and provide you with an accurate report. If it is clear that the agent is selling your land, apply for an official "denuncia", this should prevent people from legally buying the land and check any intended permission for building. Talk to your lawyer about sueing the agent responsible and start preparing a case.
In the meantime erect placards in Spanish and English on your property advising people not to buy and build. Ensure that the signs are clearly on your boundary so he can not legally take them down.
